Limited Lifetime Warranty
Except as set forth under exceptions below, EPCO Products, Inc. (EPCO) warrants its 304 and 316 stainless steel bow and stern eyes and the factory-unaltered hardware components (products) to be free from rust for five years after the date of original installation and from all other defects in materials and workmanship for the life of the boat upon which they are originally installed. These warranties are available only to the original purchaser of such boat. Provided, however, the foregoing warranties are limited by the following exceptions: EPCO's obligations under this warranty are limited to the replacement of defective products. This warranty is automatically void and unenforceable if: (a) the products are ever used in lifting the boat; or (b) the products are damaged by improper installation, unreasonable or improper use, accident, modification, exposure to caustic or corrosive substance (other than salt water) or excessive or unanticipated wear or tear.
EPCO is not liable for incidental or consequential damages occasioned by failure of its products under this warranty. This limited warranty is given in lieu of and excludes all other warranties of any kind whatsoever, expressed or implied, and all implied warranties of merchantability and fitness for a particular purpose that exceed the foregoing obligations are hereby disclaimed by EPCO and excluded from and by this limited warranty.
